Welcome to Ask An Audiologist (“we,” “us,” “our,” or “Platform”). These Terms of Use (“Terms”) govern your access to and use of our healthcare directory website as a visitor or prospective patient.

By accessing or using our Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not use our Platform.

Note: If you are a healthcare provider or practice seeking to list your business on our Platform, separate Business Terms of Use apply. Please refer to the Business Terms of Use for providers.

1. ACCEPTANCE OF TERMS

By using our Platform, you agree to:

  • Comply with these Terms and all applicable laws
  • Use the Platform for lawful purposes only
  • Provide accurate information when submitting forms or requests
  • Accept the limitations and disclaimers outlined in these Terms

2. DESCRIPTION OF SERVICES

Our Platform provides:

Healthcare Provider Directory:

  • Searchable directory of healthcare practices and providers
  • Provider information, including location, specialties, and contact details
  • Ability to browse and compare healthcare providers in your area

Educational Content:

  • Articles, guides, and resources about healthcare topics
  • General health and wellness information
  • Videos and multimedia educational content

Callback Request Service:

  • Online forms to request a callback from healthcare providers
  • Submission of your contact information to providers for follow-up

All services are provided free of charge to visitors and prospective patients.

3. NO MEDICAL ADVICE

3.1 Educational Content Disclaimer

CRITICAL: Our Platform provides general educational information only and does NOT constitute medical advice, diagnosis, or treatment.

  • Educational content is for informational purposes only
  • Content should not be used as a substitute for professional medical advice
  • Always consult a qualified healthcare provider for medical concerns
  • Do not disregard professional medical advice or delay seeking care based on information found on our Platform

3.2 No Doctor-Patient Relationship

Using our Platform does NOT create a doctor-patient relationship between you and:

  • Our company
  • Any healthcare provider listed in our directory
  • Any provider you contact through our callback request service

A doctor-patient relationship is established only through direct consultation with a healthcare provider.

3.3 Emergency Medical Situations

If you are experiencing a medical emergency, call 911 or go to the nearest emergency room immediately. Do NOT use our Platform to seek emergency medical assistance.

Our callback request service is not monitored 24/7 and should never be used for urgent or emergency medical needs.

4. USE OF THE DIRECTORY

4.1 Directory Information

Our directory provides information about healthcare providers and practices, including:

  • Names and credentials
  • Practice locations and contact information
  • Specialties and services offered
  • Business hours and availability

4.2 No Endorsement or Recommendation

We do not endorse, recommend, or guarantee the quality of any healthcare provider listed in our directory.

If we label a provider as ‘Preferred’ (or similar), that designation relates to advertising placement, membership, or profile features, and does not mean we recommend, endorse, or guarantee that provider’s services or quality of care.

Listing in our directory does not constitute:

  • A recommendation or endorsement of the provider
  • A guarantee of the provider’s qualifications, competence, or quality of care
  • Verification of credentials, licensure, or professional standing
  • Any representation about the suitability of the provider for your needs

4.3 User Responsibility

You are solely responsible for:

  • Verifying provider credentials and licensure before seeking care
  • Evaluating whether a provider is appropriate for your needs
  • Conducting your own due diligence before selecting a provider
  • Checking with your insurance company about coverage and network participation

We encourage you to:

  • Check state licensing boards to verify provider credentials
  • Research provider backgrounds and qualifications
  • Read reviews from multiple sources
  • Contact providers directly to ask questions before making appointments

5. CALLBACK REQUEST SERVICE

5.1 How It Works

Our callback request service allows you to submit a form requesting that a healthcare provider contact you. When you submit a callback request:

  • Your information (name, phone, email, inquiry details) is stored in our system
  • We forward your request to the healthcare provider you selected
  • The provider may contact you at the phone number or email you provided
  • Response times vary by provider; we do not control when or if providers respond

5.2 Your Information and Consent

By submitting a callback request form, you:

  • Consent to us sharing your contact information with the selected provider
  • Consent to the provider contacting you at the phone number and/or email address you provide
  • Understand that the provider may contact you via phone, email, or text message
  • Acknowledge that we store your callback request data as described in our Privacy Policy

If you provide your information and submit the form, you are consenting to be contacted.

5.3 No Guarantee of Response

We do not guarantee that providers will respond to your callback request.

  • Providers are independent businesses, not employed by us
  • Response times and methods vary by provider
  • Providers may choose not to respond for any reason (scheduling, insurance acceptance, etc.)
  • We are not responsible for provider communication or lack thereof

5.4 Accuracy of Information

You agree to:

  • Provide accurate and current contact information
  • Provide truthful information about your inquiry or health concern
  • Update us if your contact information changes after submission

Providing false or misleading information may result in providers being unable to contact you or assist you properly.

5.5 Not for Emergencies

NEVER use the callback request form for medical emergencies or urgent health concerns.

Callback requests are not monitored in real-time. For emergencies, call 911. For urgent medical needs, contact a provider directly or visit an urgent care facility.

6. EDUCATIONAL CONTENT

6.1 General Information Only

All educational content on our Platform (articles, videos, guides, resources, etc.) is provided for general informational purposes only.

Educational content:

  • Is not tailored to your individual health needs or circumstances
  • Should not replace professional medical advice, diagnosis, or treatment
  • May not reflect the most current medical research or guidelines
  • Is subject to change without notice

6.2 No Medical Advice

Educational content does NOT constitute medical advice.

You should:

  • Consult a healthcare provider before making any health-related decisions
  • Not rely solely on information from our Platform for medical decisions
  • Verify information with qualified medical professionals
  • Seek professional advice for any health concerns or questions

6.3 Third-Party Content

  • Use the Platform to spam or send unsolicited communications

  • Post or transmit any unlawful, threatening, abusive, defamatory, or obscene content
  • Violate any third-party rights, including intellectual property or privacy rights

7.3 Consequences of Violations

We reserve the right to:

  • Terminate or restrict your access to the Platform
  • Remove any content you have submitted
  • Report violations to law enforcement authorities
  • Take legal action to enforce these Terms

Links to third-party websites do not constitute an endorsement, recommendation, or approval of those websites or their content.

10. PRIVACY AND DATA COLLECTION

Your privacy is important to us. Our collection, use, and disclosure of your personal information is governed by our Privacy Policy for Visitors, which is incorporated into these Terms by reference.

  • We retain callback request data indefinitely for analytics and improvement purposes

11. DISCLAIMERS AND LIMITATIONS OF LIABILITY

11.1 “AS IS” Basis

THE PLATFORM IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND.

We disclaim all warranties, express or implied, including:

  • Warranties of merchantability and fitness for a particular purpose
  • Warranties of accuracy, completeness, or reliability of content
  • Warranties of uninterrupted or error-free operation
  • Warranties that the Platform is free from viruses or harmful components

11.2 No Warranty Regarding Providers

We make no warranties or representations about:

  • The qualifications, credentials, or competence of listed providers
  • The quality of care provided by listed providers
  • The accuracy of provider information in the directory
  • Provider availability, acceptance of insurance, or willingness to see new patients
  • The outcome of any medical treatment or care you receive

11.3 Educational Content Disclaimers

We do not warrant that:

  • Educational content is accurate, current, or complete
  • Educational content is suitable for your individual health needs
  • Following information in educational content will result in any particular outcome

11.4 Callback Request Disclaimers

We do not guarantee:

  • That providers will respond to callback requests
  • The timing or manner of provider responses
  • The quality of communication from providers
  • That providers can or will provide the services you seek

11.5 LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR ANY DAMAGES ARISING FROM YOUR USE OF THE PLATFORM, INCLUDING BUT NOT LIMITED TO:

  • Failure of providers to respond to callback requests
  • Reliance on directory information or educational content
  • Loss of data or information
  • Indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, or business opportunities
  • Damages arising from third-party websites or services

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE PLATFORM SHALL NOT EXCEED $100.

These limitations apply even if we have been advised of the possibility of such damages and regardless of the legal theory (contract, tort, negligence, strict liability, or otherwise).

We do not limit liability where prohibited by law, including for gross negligence, willful misconduct, or other non-waivable claims (exact carve-outs depend on your chosen governing law).

We are not responsible for services provided by third-party providers.

11.6 Basis of the Bargain

You acknowledge that these disclaimers and limitations of liability are fundamental elements of the agreement between you and us, and that we would not provide the Platform to you without these limitations.

12. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless us, our affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys’ fees) arising from:

  • Your use of the Platform
  • Your violation of these Terms
  • Your violation of any law or regulation
  • Your violation of any third-party rights
  • Information you provide in callback requests
  • Any negligence or misconduct on your part

This indemnification obligation survives termination of these Terms.

13. DISPUTE RESOLUTION

13.1 Governing Law

These Terms are governed by the laws of the State of Indiana, United States, without regard to conflict of law principles.

13.2 Informal Resolution

Before filing any legal action or initiating arbitration, you agree to first send us a written notice of the dispute (a “Notice of Dispute”) and attempt to resolve the dispute informally. The Notice of Dispute must include your name, mailing address, email address, phone number, a description of the dispute, and the relief you are seeking. You must send the Notice of Dispute to us by email at info@askanaudiologist.com

and by mail to: Entheos Audiology Cooperative, Inc., Attn: Legal, 1501 S Clinton St, #10311 Fort Wayne, IN 46851. We will attempt to resolve the dispute within 30 days after we receive your Notice of Dispute. If we cannot resolve the dispute within that timeframe, either party may proceed as set forth in Section 13.3 below.

13.3 Arbitration Agreement

PLEASE READ THIS SECTION CAREFULLY. THIS SECTION AFFECTS YOUR LEGAL RIGHTS.

Agreement to Arbitrate. Except as described below, any dispute, claim, or controversy arising from or relating to these Terms or your use of the Platform will be resolved by binding arbitration and not in court.

Exceptions. This arbitration agreement does not apply to:

  1. claims that may be brought in small claims court, if eligible
  2. claims for injunctive or equitable relief
  3. claims related to intellectual property rights

Administrator and Rules. The arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules in effect at the time the arbitration is filed.

Location and Format. The arbitration will take place in Fort Wayne, IN, unless you and we agree otherwise. The parties may also agree to conduct the arbitration by videoconference, telephone, or written submissions, and the arbitrator may allow those formats where permitted by the applicable rules.

Fees and Costs. Payment of arbitration fees and costs will be governed by the applicable AAA rules. Each party will bear its own attorneys’ fees unless the arbitrator awards attorneys’ fees under applicable law.

Authority of the Arbitrator. The arbitrator may award the same damages and relief that a court could award, but only to the extent permitted by law and these Terms. The arbitrator’s decision is final and binding.

Waiver of Jury Trial. You and we each waive the right to a jury trial.

Class Action Waiver. You and we each agree that disputes will be brought only in an individual capacity and not as a plaintiff or class member in any purported class action, collective action, private attorney general action, or other representative proceeding. The arbitrator may not consolidate claims or preside over any form of representative or class proceeding.

Opt Out. You may opt out of this arbitration agreement by sending written notice within 30 days of the date you first accept these Terms. Your opt out notice must include your name, mailing address, email address, and a clear statement that you want to opt out of arbitration. Send your opt out notice to info@askanaudiologist.com and to: Entheos Audiology Cooperative, Inc., Attn: Legal, 1501 S Clinton St, #10311 Fort Wayne, IN 46851. If you opt out, Section 13.4 will apply to disputes.

13.4 Venue

For any disputes not subject to arbitration, you agree to submit to the exclusive jurisdiction of the state and federal courts located in Indiana, and you and we consent to personal jurisdiction and venue in those courts.

13.5 One-Year Limitation Period

To the extent permitted by law, you must commence any legal action or arbitration within one (1) year after the claim arises. After one year, the claim is permanently barred.

14. GENERAL PROVISIONS

14.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding your use of the Platform.

14.2 Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of changes by:

  • Posting updated Terms on the Platform
  • Updating the “Last Updated” date
  • For material changes, we may provide additional notice on the Platform

Your continued use after changes take effect constitutes acceptance of the modified Terms.

14.3 Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in full force and effect.

14.4 Waiver

Our failure to enforce any provision does not constitute a waiver of that provision or any other provision.

14.5 Assignment

You may not assign or transfer your rights under these Terms. We may assign these Terms to any affiliate or successor.

14.6 Force Majeure

We are not liable for any failure or delay in performance due to circumstances beyond our reasonable control.

14.7 Survival

Provisions that by their nature should survive termination will survive, including disclaimers, limitations of liability, indemnification, and dispute resolution.

14.8 No Third-Party Beneficiaries

These Terms do not create any third-party beneficiary rights.

14.9 Headings

Section headings are for convenience only and do not affect the interpretation of these Terms.

14.10 Electronic Communications

You consent to receive communications from us electronically. Electronic communications satisfy any legal requirement for written communication.

16. ACKNOWLEDGMENT

BY USING OUR PLATFORM, YOU ACKNOWLEDGE THAT:

  • You agree to be bound by these Terms
  • You understand that our Platform provides directory and educational information only
  • You will not rely on our Platform for medical advice, diagnosis, or treatment
  • You will verify provider credentials before seeking care
  • You understand the limitations and disclaimers outlined in these Terms
  • You accept all risks associated with using our Platform and contacting healthcare providers

If you do not agree to these Terms, you must immediately cease using the Platform.
